DePuy Recall Lawyers Scheduled to Meet With MDL Court This Month

The lawyers looking to head up the DePuy hip recall litigation are scheduled to meet with the federal judge that is presiding over the recently established mult-dirstrict litigation (MDL) on January 20th. This meeting will allow attorneys that are seeking leadership roles to address the Court.

Last month, a U.S. Judicial Panel ruled to consolidate all federal DePuy hip recall lawsuits before U.S. District Judge David A. Katz in the Northern District of Ohio.

The meeting scheduled for later this month will give both defense and plaintiffs’ attorneys the opportunity to meet Judge Katz for the first time and will likely end with the Judge selecting which attorneys will serve in leadership roles for the each side.

Over 100 DePuy hip recall lawsuits have already been transferred to the MDL Court, and thousands more are expected to be filed or transferred in the coming months.

The claims are being consolidated in an effort to reduce the burden on the court system. All of the cases that have been and will be filed under the MDL will have similar allegations against a common defendant, DePuy Orthopedics and its parent company Johnson & Johnson. Many claims will be seeking similar damages resulting similar injuries and much of the same discovery will be applicable to a majority of the claims.

DePuy ASR hip implants were recalled by DePuy last year after it was discovered that the metal on metal implants had an extremely high rate of failure, but most of damage had already been done. Over 90,000 people were implanted with the defective devices between the 2005 launch and the recall some five years later.

    had depuy asr hip implant 12/08. within 6orse and 0 days of implant had pain in leg between hip and knee got so bad went back to surgeon, took x-rays and said everything was ok after 6 cortizone shots(two in hip and four in back), because kept on telling me pain in leg was comming from back not hip i went to a back specialist and he looked at all my mri’s(2) and ultra-sound and blood tests(which they said were negative) he sent a memo to my surgeon telling him the pain in leg was from my hip not back. two weeks later i had hip revision and surgeon told me in recovery that i ime before allhad fluid build up from metal on metal hip movement and more than likely there was metal shaving in my leg muscle. it has been 5 weeks since rivision and i hope i will have full range of motian and no pain. he says only time will tell and not sure how long it will take for metal to get out of my system. my belief is that it’s only a matter of time before all those hips go bad. as a person gets older and the hip compresses with age and use they will all be having metal shaving going some where. i consider myself some what lucky because my blood tests for cobalt& chromium were ok and hopefully the metal in my leg will work it’s way out.
