An east Texas woman has filed a product liability lawsuit claiming that bone screws used in her spinal surgery are defective. The suit alleges that orthopedic bone screws made by Alphatec Spine are defective in their design causing the screws to fracture and break. Read the SE Texas Record story here.
According to the suit the screws were used in a spinal surgery completed in January of 2006. In October of 2007 an x-ray showed that one of the screws had broken. Despite the broken screw the plaintiff claims that based on conversations with her physicians she believed that the back pain she was having was manageable and was not caused by the screw.
By November 2007 the pain was no longer manageable. An MRI then revealed a second fractured screw, which required additional surgery.
The orthopedic screws named in the suit are 40mm x 6.5mm Zodiac polyaxial screws.
The plaintiff is seeking damages for medical expenses, lost earnings, loss of earning capacity, physical impairment, disfigurement, financial losses, pain and suffering, mental anguish and court costs.
